WASHINGTON (Worthy News) – A prominent U.S. senator who served as a Navy pilot and later as an astronaut faces a Pentagon investigation — and a possible court-martial — after joining a handful of lawmakers in a video urging U.S. troops to refuse “illegal orders” under President Donald J. Trump.
The Pentagon — the U.S. Department of Defense — confirmed it is reviewing the actions of Democratic Senator Mark Kelly, 60, of Arizona, citing federal law that allows retired military officers to be recalled to active duty and placed under the Uniform Code of Military Justice (UCMJ).
A court-martial is a military tribunal that can try service members for violations of military law, with penalties ranging from reprimands to imprisonment, though recalling a retired officer for such proceedings is extremely rare, observers say.
Pentagon officials stressed that no charges have been filed but confirmed the review is underway — an unusual step for a retired Navy captain and sitting U.S. senator.
The controversy intensified after Trump accused the lawmakers of “sedition punishable by DEATH” in a social-media post, further inflaming political tensions.
FLYING MANY MISSIONS
Kelly, a former combat aviator who flew 39 missions during Operation Desert Storm and later became a NASA astronaut, has not directly addressed the probe. His office said only that he “supports the rule of law and the constitutional duties of the U.S. military.”
The video — recorded with several Democratic legislators — stated that U.S. military personnel must refuse any “unconstitutional or unlawful” orders. Supporters say the message reaffirmed long-established military rules requiring troops to disobey illegal commands.
Republican allies of Trump accused Kelly of undermining discipline in the armed forces. House Speaker Mike Johnson said the video “encourages disobedience within the ranks.”
Separately, U.S. Defense Secretary Pete Hegseth called the lawmakers’ video “despicable, reckless and false,” arguing that Kelly is the only participant subject to potential military discipline because he is a retired Navy officer.
Hegseth has also mocked Kelly’s military credentials, saying: “You can’t even display your uniform correctly. When — or if — you are recalled to active duty, it’ll start with a uniform inspection.”
CROSSING LEGAL BOUNDARIES?
Legal experts emphasize that while retired military officers technically remain subject to the UCMJ, actual court-martial proceedings against retired elected officials are extraordinarily rare and would likely face constitutional challenges.
A Defense Department official, speaking on background, said investigators will assess whether Kelly’s statements “crossed legal boundaries for a retired officer” or fall under protected political speech.
The White House declined to comment.
Senate Democrats accused Trump of attempting to “intimidate political opponents,” while urging the Pentagon to keep its review independent of partisan pressure.
